VI. Support Service

The Ninox Company offers its customers the Support Service at the phone number +373 (0) 621 81 807. The working days of the Support Service are Monday-Friday, working hours 10.00-17.00.
The Support Service provides consultation to customers regarding the goods and services offered by the Electronic Store, the methods of payment, delivery and revocation of the Payment Operation/Transactions carried out. The support service is obliged to receive complaints from Customers, to inform them about the status of the complaint investigation process, and, as the case may be, to ensure the investigation of complaints.

VII. Products

The products will be delivered based on your order, subject to availability. Thus, the Company reserves the right not to honor an order, if the respective product no longer exists in the Company's stock for various reasons. Users expressly agree that using this site and purchasing products is at their own risk.

VIII. Prices

Prices are set at the time the products are displayed on the website and include VAT, but do not include delivery charges. With the exception of cases where it is provided otherwise, the prices of the products displayed on the Ninox website represent the final purchase prices and include VAT (value added tax of 20%, valid in the Republic of Moldova). The final purchase prices can be prices suggested by manufacturers or suppliers, or can be estimated according to the standard prices practicable at the level of the industry of the marketed product. The final purchase prices may not represent the most competitive prices in a particular product segment or for a particular period.

IX. Receiving orders

Orders are placed electronically, using the order form. By placing an order on our site, you give your consent to the use of your data (including data added later) for the purpose of delivering the requested products, services and information. We understand that as soon as you accept the Terms and Conditions, we have your consent to use the information provided by you. In order to exclude a possible fraud, it is forbidden to provide false or incomplete data when completing an order. We reserve the right to take legal action against individuals who provide false information.
Once the order is placed, you agree to the specific terms stated on the order page and to the product prices and shipping cost displayed in the shopping cart. We reserve the right to store customer information: name, address, email, phone, CNP, ordered products, for the duration necessary to fulfill the orders and in order to create statistics.
We may cancel the order placed by you, upon prior notice, without any further obligation of either party to the other or without either party being able to claim damages from the other in the following cases:
- non-acceptance by the issuing bank of the client's card, non-acceptance of the transaction, in the case of online payment;
– invalidation of the transaction by the card processor approved by us, in the case of online payment;
– the data provided by you on the site is incomplete and/or incorrect.
The price, payment method and payment term are specified in the order. The seller will issue an invoice to the buyer for the delivered products, the buyer's obligation being to provide all the information necessary to issue the invoice in accordance with the legislation in force.

X. How do we buy? The technology of making the purchase

XI. How do we pay? The technology of making the payment transaction

Before proceeding with the completion of the Payment Operation, all the basic parameters and conditions of the Sale aimed at payment must be made available to the Buyer:
– the unique identifier of the Order;
– the price and quantity of each product / service within the Transaction;
– if the Transaction involves delivery:
• Delivery conditions – full or only reference to the Commercial Conditions, and if the Conditions’ provisions provide for different methods of delivery, then the method of delivery applicable to this Transaction must also be clearly indicated;
• Delivery data (surname, first name, phone number of the Recipient, delivery address);
• The delivery price, if the respective payment is applied;
• checks __________ (name of the document (eg, passport data) of the Recipient, to be performed upon delivery of the Parcel.
• Other payments if applicable within this Transaction;
• The total value of the order, equal to the amount of the Payment Operation that will be initiated by the Merchant to pay for the given Sale;
• Reference and active link to the Commercial Conditions;
• Other special conditions possibly applicable to the given Transaction.
This information is necessary for the correct and efficient processing of the order placed by you.
Please fill in the form correctly and indicate the persons to whom the invoice is made and the delivery is made. Your email address is extremely important as order information and information about ordered products will be sent to you via email. An incorrect email address slows down the entire ordering process. Moreover, the Company will not be able to contact you and inform you about the status of your order. If the delivery address is not the same as the billing address, indicate this by unchecking the option. The shipping address is the same as the billing address at the end of the form. If the delivery address, or the billing address, or both addresses are not the same as the addresses you have registered in your user account on the Site, before proceeding to the next step in the process of placing the order, enter the billing addresses and / or delivery valid for the respective order.
Prior to the initiation of the Payment Transaction, the Buyer must present his agreement regarding the Commercial Terms and Conditions by ticking the "I have read and agree with the “Terms and Conditions" box. Payment can be made through the payment instruments offered by "Paynet Service" SRL. The ordered products must be paid in full, otherwise the delivery will not be made.
The website www.ninoxfashion.com is secure, Ninox does not store your personal, account or card details used in making an online transaction.

XII. Delivery and return

The products will be delivered anywhere in the country (the Republic of Moldova) and outside the country (except for certain areas) through courier companies. In case of local deliveries, Ninox predominantly uses the courier services of the FAN Courier company, which offers customers the best fast delivery services in the "door-to-door" system under maximum safety conditions for domestic shipments. FAN Courier guarantees the delivery of any domestic shipment in good condition and in full confidentiality, anywhere on the territory of the Republic of Moldova within 24 (twenty-four hours), without exceeding 2 (two) working days. Delivery times do not include public holidays, force majeur and fortuitous case.

Delivery in Chisinau

Delivery is free if the purchase amount exceeds 2500 MDL. In other cases, the delivery cost is 50 MDL. In the case of weekend delivery, the delivery cost is 70 MDL. Terms of delivery - the Orders are carried out within 24 (twenty-four hours), without exceeding 2 (two) working days.

Delivery on the territory of the Republic of Moldova

Delivery is free if the order amount exceeds 2500 MDL. If the amount of the order does not exceed the value of 2500 MDL, the delivery cost is 70 MDL. In the case of weekend delivery, the delivery cost is 85 MDL, depending on the fluctuations of the cost of transport fuel. Terms of delivery of orders are carried out within 24 (twenty-four) hours, without exceeding 2 (two) working days.

Delivery to the EU states, the USA and other countries

is made through the DHL company, which applies tariffs depending on the weight of the order, its value and the country of destination.

XIII. Return and refund policy

Ninox makes every effort to be as accurate as possible. However, Ninox does not warrant that product descriptions or other related materials are accurate, complete, current, or error-free. If a product offered by Ninox is different from its related description on the Site, you can return it in compliance with the provisions of the Site's Product Return Policy and in accordance with the legislation of the Republic of Moldova in force.

Drepturi de retur

The commercial relations between the Buyer/beneficiary and Ninox are officially regulated by the consumer protection bodies for the conclusion and execution of distance contracts. In accordance with the legal provisions, we inform you of the following:
The Buyer has the right to notify the trader in writing that he/ she is canceling the purchase, without penalty and without giving a reason, within 14 working days of receiving the product or, by returning within this period the purchased product in its original packaging, with all labels intact and without showing any signs of damage or wear.
In this case, the Company will refund the amounts paid by you, within 14 days at most from the date of receipt of the product returned by you under the conditions presented above. According to the provisions in force, in this case the Buyer will bear only the shipping costs for returning the products.
RETURNS ARE ONLY ACCEPTED BY COURIER. The return courier fee is borne by the Buyer.

The returned product must be in perfect condition. The product is not received if it is damaged, if it does not have the tags intact, if it shows signs of wear or wear, or if it is missing accessories
The electronic store www.ninoxfashion.com or the Buyer has the possibility to initiate both the Revocation of the Payment Operation/Transaction in total amount and in partial amount, arising from the nature and cause of the revocation.
In case the delivery is impossible or has not been carried out within the maximum period of 30 (thirty) days from the date of confirmation of the respective Payment Operation, Ninox is obliged to initiate the Revocation of the respective Payment Operation/Transaction, except in cases where it has been received from the Buyer the express written agreement regarding the extension of the delivery term.

Risk of loss

All items purchased on the Website are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to You upon our delivery to the carrier.
After the Buyer has entered the payment data, confirmed and authorized its execution, it will not be possible to make changes, revoke the payment and return the financial means related to this payment. In this case, the Beneficiary cannot request the reimbursement of the transferred funds, and the Operator will not take into account the Beneficiary's claims regarding the reimbursement of the funds.

XIV. Communication with the Customers

Ninox and/or in general the suppliers of products or services to Ninox cannot be held responsible for any delay or error resulting directly or indirectly from causes beyond Ninox's control. This waiver includes, but is not limited to: malfunctions of Ninox technical equipment, failure of Internet connection, failure of telephone connections, computer viruses, unauthorized access to Ninox systems, operating errors, as well as cases of force majeure major stipulated by the legislation of the Republic of Moldova in force.

XVIII. Applicable Law

The services offered by the Company through Ninox are governed by the provisions of the laws of the Republic of Moldova, especially by LAW No. 284 of 22-07-2004 regarding electronic commerce. The provisions of this Law are supplemented by the provisions of Law no. 133/2011 regarding the protection of personal data, Law no. 114/2012 regarding payment services and electronic money, Law no. 91/2014 regarding the electronic signature and the electronic document, Law no. 105/2003 regarding consumer protection and Law no. 8/2016 on consumer rights when concluding contracts, and Directive 2000/31/EC of the European Parliament and of the Council of June 8, 2000 on certain legal aspects of information society services, especially electronic commerce on the internal market.

XIX. Litigation - Final and Judicial Dispositions

The Ninox’ Terms and Conditions are subject to the legislation of the Republic of Moldova. Any dispute arising in connection with the use of this service will be resolved amicably. When conflicts arise during the purchase, payment or delivery of products purchased from the Ninox company, and which are not regulated by a clause of this act, they will be resolved amicably, within 30 working days from the moment of registration of the complaint in written form at the Ninox headquarters. If the conflict cannot be resolved amicably, the disputes between the Parties will be subject to the jurisdiction of the courts of the Republic of Moldova. By agreeing to these terms and conditions, the customer assumes all such risks.
